Town Of Stouffville Takes Legal Action To Ensure Compliance With Zoning By-Law

The Town of Stouffville has obtained an interim court order to enforce compliance with its Comprehensive Zoning By-law concerning the property located at 6165 Vivian Road, Whitchurch-Stouffville. The Town started the legal action to address and prevent the unauthorized use of the property at 6165 Vivian Road as an event and party rental venue, ensuring its use aligns with the permitted uses set out in the Town's zoning regulations.

The Ontario Superior Court of Justice issued an interim injunction in the Town’s favour on June 19, 2024.

The Court Order:

  1. Restrains Unauthorized Use: The property at 6165 Vivian Road may not be used in any manner, except in compliance with Sections 3.1 and 4.1 of the Town’s Comprehensive Zoning By-law.
  2. Access Restriction: The Town is granted permission to block or restrict access to the property by any reasonable means, including barricades or vehicles, to prevent any non-permitted use.
  3. Cost Recovery: All expenses incurred by the Town in relation to enforcing the order may be added to the property’s tax roll and collected as realty taxes.

The Town of Stouffville remains committed to upholding its zoning regulations and ensuring that all properties within its jurisdiction comply with established by-laws.
