Proposed Development
The Town has received a Complete Application for Zoning Bylaw Amendment for the subject property to consider a proposed development for the property which is accessed from Stapleton Avenue and legally described as Part Lot 16 Concession 8 and Parts 4 and 5 Plan 65R-41296 Whitchurch-Stouffville. What are the Proposed Changes?
The application for Zoning By-law Amendment (ZBA) seeks permission for the development of the subject property with a residential plan of subdivision comprised of 18 separate residential lots with a total of 35 dwelling units. The dwelling units will be comprised of:
- Ten (10) Single Detached dwellings
- Six (6) Semi-Detached Dwellings
- Six (6) Townhouse Dwellings
- Ten (10) Cluster Home Dwellings
- Three (3) Apartment Dwellings
There are also blocks proposed for an open space block as well as a private roadway.
Site-specific zoning regulations have been proposed and will be reviewed with the conceptual site plan.

Appeal Procedure
In accordance with Bill 185, which received Royal Assent on June 6th, 2024, the Minister, the applicant, or a specified person, public body, or registered owner of any land to which the By-law will apply, who made oral submissions at a Public Meeting or written submissions to Town Council prior to the passage of the By-law, may appeal the By-law to the Ontario Land Tribunal. Third-party appeals are no longer permitted – meaning neighbours, individuals, companies, and ratepayer groups can no longer appeal development applications.
If a person or public body would otherwise have an ability to appeal the decision of the Town of Whitchurch-Stouffville to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Town of Whitchurch-Stouffville before the proposed Zoning By-law amendments are passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Whitchurch-Stouffville before the proposed Zoning By-law amendments are passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
In the event of an appeal to the Ontario Land Tribunal, your written submissions and contact information will be provided to the Tribunal. If you do not wish your contact information to be released to the Tribunal by the Town, please advise the Town accordingly in writing.
