Safety Camera Penalties

The Town of Newmarket helps the Town of Stouffville by reviewing images from speed cameras. When a camera captures a speeding vehicle, the images are sent to a processing centre for review by a Provincial Offences Officer. The registered owner of the vehicle receives a Penalty Order, which includes a digital image of the vehicle and a close-up of the license plate. Penalty Orders are mailed to the registered vehicle owner within 30 days of the offence.

Driving records and demerit points

The Penalty Order is issued to the registered vehicle owner and includes a fine, however, it does not affect the vehicle owner's driving record, Commercial Vehicle Operator’s Registration, or insurance. No demerit points are applied.

If fines remain unpaid, they may affect the renewal of your license plate with the Ministry of Transportation.

What to do when you receive a ticket

The Penalty Order will provide options in detail, but you have two options:

  1. Pay the penalty as instructed.
  2. Request to dispute the penalty.

If you don't take action within 30 days, the Penalty Order will be confirmed, and you will be required to pay the fine. After 30 days, unpaid fines go into default status (also known as plate denial), and an additional fee will be added by the Ministry of Transportation. You must pay the fine and any extra fees at a Service Ontario location before you can renew your license plate.

If you have lost your Penalty Order, the registered plate owner can contact the Town for assistance at (905) 640-1900 ext. 2700 or ase@townofws.ca.

How to pay a ticket

There are three ways to pay a ticket:

  1. Pay online using VISA, MasterCard or American Express at disputeorpay.ca

  2. Pay in-person at the Town’s Municipal Office during regular business hours or using the secure drop box outside the front entrance (no cash)

  3. Pay by mail using a cheque or money order payable to the Town of Stouffville. Write the Unique File Number found on the top right of your Penalty Order and your license plate number on the front of your cheque or money order. Mail to: Town of Whitchurch-Stouffville – Customer Service, 111 Sandiford Drive, Stouffville, Ontario L4A 0Z8

Do not send cash by mail
Payment must be received by or on the due date.

How to dispute a ticket

A vehicle owner may request an appeal of their Penalty Order by requesting a review with a Screening Officer in writing, no later than 30 days after the penalty order was deemed served. A vehicle owner may schedule an appeal of their Penalty Order through one of the following methods:

  1. Online at disputeorpay.ca
  2. In-person at the Town of Stouffville’s Municipal Office, 111 Sandiford Drive, Stouffville, ON. Open Monday to Friday, 8:30 a.m.- 4:30 p.m. (excluding statutory and civic holidays).

Fine amounts

The Province of Ontario regulates ASE fines (Highway Traffic Act - Regulation 355/22). The total fine includes three components:

  1. Set Penalty: Calculated based on the kilometres over the speed limit, multiplied by the rate set in Regulation 355/22.

  2. Victims’ Justice Fund Surcharge: Municipalities that operate an ASE Program are required to collect and submit Victim Fine Surcharge fees to the Province to support services and programs for victims of crime in Ontario. The amount of the surcharge is dependent upon the amount of the fine issued. Further information on this can be found in Ontario Regulation 161/00: Victim Fine Surcharges.
  3. MTO Search Fee: An $8.25 fee covers the cost for authorized personnel to access the name and address of the plate owner to facilitate the mailing of the Penalty Order.

For example, a vehicle speeding 15 km over the limit incurs a fine of:
$75 (15 km x $5 [penalty rate]) + $15 [Victims' Justice Fund] + $8.25 [MTO Search Fee] = $98.25.
